General Conditions for the Purchase of LA VACCHETTA GRASSA Products and Services
LA VACCHETTA GRASSA invites every user to carefully read these general conditions of sale of products and services (the "General Conditions"), before finalizing any purchase and, once this operation is concluded, to print or save a digital copy of them.
The General Conditions govern the distance purchase of products and services promoted on the website eshop.lavacchettagrassamodena.it (the "Site"), owned by La Vacchetta Grassa di Cuoio di Modena srl Corso Canalchiaro 42/44 - 41121 Modena (MO) Italia.
The products distributed by LA VACCHETTA GRASSA through its Site consist, in particular, of handcrafted leather goods.
The terms and methods for the purchase of Products and/or Services offered by LA VACCHETTA GRASSA through the Site are contained in these General Conditions.
The offer of LA VACCHETTA GRASSA Products and Services is addressed both to consumer users and to other users. Consumer users ("Consumer/s") are defined as those subjects who purchase the Products and/or Services presented on the Site for purposes unrelated to any entrepreneurial or professional activity carried out by them, in accordance with the provisions of Legislative Decree no. 206 of 6 September 2005 (the "Consumer Code"). For the purposes of these General Conditions, a person who, upon purchasing a Product or Service, expressly indicates in the field reserved for entering personal data that they belong to the category "Companies, entities, professionals holding a VAT number," by simultaneously entering their VAT number, is not considered a Consumer. Where no express reference is made to the category of Consumers, the provisions of the General Conditions and the Special Conditions apply indistinctly to all users who purchase Products and/or Services through the Site (the "Customers").
LA VACCHETTA GRASSA may modify the General Conditions without any prior notice. These modifications will be effective from the date of their publication on the Site. The General Conditions in force at the time the sales contract was concluded will apply to purchase orders submitted to LA VACCHETTA GRASSA before the publication of the aforementioned modifications.
The General Conditions are available in the Italian language.
Purchase Procedure – Conclusion of the Sales Contract
All products and items offered by LA VACCHETTA GRASSA are UNIQUE PIECES, handcrafted by hand. By their very nature, therefore, they always present elements of difference and uniqueness that make them absolutely "unique," meaning slightly different from one another. Such "uniqueness" and such differences – whether attributable to the leathers or ascribed to the processing – are normal in artisanal workmanship and, in fact, enhance and increase the value of the product itself.
Consequently, the visual representation of the Products on the Site, where available, generally corresponds to the photographic image of the same and has the sole purpose of presenting them for sale, without any explicit or implicit guarantee or commitment by LA VACCHETTA GRASSA regarding the exact correspondence of the image shown on the Site with the actual product, especially with regard to its dimensions and/or the color and aesthetic aspects of the leathers.
The publication of Products and/or Services on the Site constitutes an invitation to users to make a purchase proposal to LA VACCHETTA GRASSA. Each order sent by the Customer constitutes a contractual proposal (the "Order") and constitutes specific acceptance of these General Conditions.
During the process of placing the Order and also subsequently, the Customer can modify the information entered in the appropriate data entry fields at any time. Should a specific Product and/or Service be presented on the Site in an area other than those intended for purchase operations or, in any case, if it is not possible to select the "Proceed to purchase" icon, it should be understood as not available for sale. The Customer will then proceed to review the data entered in the Order and confirm and transmit it to LA VACCHETTA GRASSA by clicking on "Proceed to purchase." To proceed with the purchase, it will be necessary to read and accept the General Conditions, as well as the Specific Conditions where applicable.
Upon receipt of the Order, LA VACCHETTA GRASSA automatically sends the Customer a confirmation email containing the details of the Order and all data relating to the purchase, namely the type of Products and/or Services requested and the relative costs.
LA VACCHETTA GRASSA has the right to accept or reject the Orders received without the Customer being able to assert any rights or claims against LA VACCHETTA GRASSA in the event of non-acceptance, for any reason. The sales contract will be considered concluded (i) upon acceptance of the Order by LA VACCHETTA GRASSA sent to the Customer's email address or (ii) tacitly if 48 hours have elapsed since the receipt of the Order (the "Sales Contract").
Once the acceptance of the Order by LA VACCHETTA GRASSA has been received, the latter will proceed with the shipment of the selected Products, which will be communicated to the Customer via email.
Each Sales Contract will be stored by LA VACCHETTA GRASSA through an electronic system and may be viewed, if necessary, both by LA VACCHETTA GRASSA personnel and by any third parties it uses for the execution of the Sales Contract.
Price of LA VACCHETTA GRASSA Products and Services – Product Availability
The prices published on the homepage or in the different sections of the Site dedicated to each individual Product and/or Service are inclusive of VAT and do not include any taxes, duties, and levies applicable in the destination Country of the Products and/or Services where this is different from Italy. These costs, which vary from Country to Country, are the responsibility of the Customer, who must verify the amount with the competent customs authorities.
The cost of shipping must be added to the price of the individual Product and/or Service, the amount of which may vary based on the delivery and payment method, as well as in relation to the destination Country. The total amount due for the chosen Products and/or Services will be clearly indicated and communicated to the Customer before the conclusion of the Sales Contract.
The Prices reported on the Site are subject to possible variations and/or modifications by LA VACCHETTA GRASSA without any obligation of prior notice to the Customer. These increases may depend - among others - on increases decided by LA VACCHETTA GRASSA's suppliers. The prices in force at the time of receipt of the Order will apply to Sales Contracts concluded before the publication of the aforementioned modifications but still being executed.
Payment Methods
Payments in execution of the Sales Contracts can be made by credit card or with the PayPal system. When placing the Order, the Customer is required to indicate the chosen payment method.
Should the Customer decide to proceed with the purchase of the Products and/or Services with payment of the price via credit card or PayPal, the total amount due for each Sales Contract will be debited simultaneously with the conclusion of the order process.
LA VACCHETTA GRASSA reserves the right to ask the Customer, at any time, for the submission of supplementary information and/or documents proving ownership of the credit card used for the completion of the Sales Contract. Should the Customer not comply with the requests, LA VACCHETTA GRASSA reserves the right not to accept the Order, or to withdraw from the perfected Sales Contract, giving prompt notice to the Customer at the email address indicated in the Order.
Payment via PayPal will occur by redirecting to the PayPal site, where the procedures for transferring the sums due to LA VACCHETTA GRASSA can be completed. The Customer's financial data will be managed directly by PayPal and will not be shared with LA VACCHETTA GRASSA. The total amount relating to each Sales Contract will be debited simultaneously with the conclusion of the order process.
Communications and Complaints
All communications or any complaints against LA VACCHETTA GRASSA must be addressed to the LA VACCHETTA GRASSA Customer Service.
Intellectual Property Rights
The Customer declares and acknowledges that all trademarks, designs, models, distinctive signs, works of authorship, software, and databases, or any other intellectual and industrial property right accessible from and/or reproduced on the Site in any manner and/or form, including the LA VACCHETTA GRASSA trademark, are the exclusive property of LA VACCHETTA GRASSA di Cuoio di Modena srl or that LA VACCHETTA GRASSA is its legitimate licensee (the “Intellectual Property Rights”). LA VACCHETTA GRASSA is not responsible, however, for the intellectual property rights related to the Products and/or Services for sale, whose owners are expressly indicated therein. Any use of the Intellectual Property Rights in any manner and/or form, in whole and/or in part, is prohibited without the prior written authorization of LA VACCHETTA GRASSA or its licensors.
Terms of Withdrawal
Customer's Right of Withdrawal – Withdrawal by LA VACCHETTA GRASSA
Pursuant to Articles 64 et seq. of the Consumer Code, the Consumer has the right to withdraw from the purchase without any penalty and without specifying the reason. To this end, they must send a communication to the LA VACCHETTA GRASSA Customer Service via email (at: info@lavacchettagrassamodena.it) or – alternatively – by fax or registered letter with return receipt, to be sent within 14 working days from the receipt of the chosen Products and/or Services.
The Products subject to withdrawal must be returned, at the Consumer's care and expense, by courier of their choice, to the following address: La Vacchetta Grassa di Cuoio di Modena srl Corso Canalchiaro 42/44 - 41121 Modena (MO) Italia.
For the valid exercise of the right of withdrawal, the Consumer must comply with the following conditions and procedures:

The withdrawal may also apply limitedly to individual Products subject to a single Sales Contract, provided that the Consumer cannot exercise withdrawal limitedly to a part of the single Product purchased;

All Products for which the Consumer has exercised the right of withdrawal must be returned intact and properly packaged, preferably in their original packaging, accompanied by any accessories.

Should the Product for which the right of withdrawal has been exercised arrive damaged at LA VACCHETTA GRASSA, the latter will only be obliged to inform the Consumer in order to allow them, where possible, to exercise their right of recourse against the courier chosen for the return of the products;

LA VACCHETTA GRASSA will not be responsible in any case for damage, theft, or loss of returned Products, until they are re-delivered. Every risk will, therefore, be the exclusive responsibility of the Consumer.
Once the integrity of the returned Product has been verified, LA VACCHETTA GRASSA will refund the Consumer the full amount paid for the Products and/or Services covered by the Sales Contract subject to withdrawal, no later than 14 days from the receipt of the same from the Customer's communication of withdrawal, without prejudice to the right of LA VACCHETTA GRASSA to withhold the refund until the returned products are received. The refund will be made using the credit card details provided by the Consumer when placing the Order.
Should the Consumer violate, in whole or in part, the provisions concerning withdrawal set out in these General Conditions, the Sales Contract will remain valid and effective, and LA VACCHETTA GRASSA will return the unduly returned Products to the Consumer, charging the latter the relative shipping costs.
LA VACCHETTA GRASSA has the right to withdraw from any Sales Contract concluded by the Customer or Consumer, by giving written notice to the same via e-mail and registered letter with return receipt, just as it may not accept any Order from users or Customers who have engaged in irregular conduct, have not accepted the Products purchased via cash on delivery, are suspected of unlawful behavior, or where required by an order from a judicial authority.
Warranty - Returns
If the Products or Services benefit from a conventional warranty recognized by the manufacturer, any defects, faults, or non-conformities must be reported directly to the manufacturer as indicated on the Product packaging or in the descriptive brochure. Except for mandatory legal provisions, LA VACCHETTA GRASSA declares that it has no responsibility regarding product defects, faults, or non-conformities. The warranty for the Consumer pursuant to Legislative Decree 206/2005 remains valid.
In this case, the Consumer must, under penalty of forfeiture, report the discovered defect to the LA VACCHETTA GRASSA Customer Service (at: info@lavacchettagrassamodena.it) within 2 (two) months from the date of discovery.
LA VACCHETTA GRASSA will make every reasonable effort to replace the defective product at its own expense and within a reasonable period. If this is not possible, or if it proves excessively burdensome for LA VACCHETTA GRASSA, the Consumer will have the right to terminate the Sales Contract and, consequently, to obtain a refund of the amounts paid for the purchase and shipping of the Product, with the exclusion of any further liability of LA VACCHETTA GRASSA, for any reason or cause.
If the Customer finds any discrepancies between what was ordered and what was received, and in particular, finds any problem concerning the physical integrity, correspondence, or completeness of the received products, they must promptly inform LA VACCHETTA GRASSA Customer Service. Customer Service will provide the necessary instructions for resolving the problem, and where possible, for shipping missing items, replacing defective items, or refunding them. In no case will the Customer be required to return defective or mistakenly received items at their own expense.
