Intellectual Property Rights

The Customer declares and acknowledges that all trademarks, designs, models, distinctive signs, works of authorship, software, and databases, or any other intellectual and industrial property right accessible from and/or reproduced on the Site in any manner and/or form, including the LA VACCHETTA GRASSA trademark, are the exclusive property of LA VACCHETTA GRASSA di Cuoio di Modena srl or that LA VACCHETTA GRASSA is its legitimate licensee (the “Intellectual Property Rights”). LA VACCHETTA GRASSA is not responsible, however, for the intellectual property rights related to the Products and/or Services for sale, whose owners are expressly indicated therein. Any use of the Intellectual Property Rights in any manner and/or form, in whole and/or in part, is prohibited without the prior written authorization of LA VACCHETTA GRASSA or its licensors.

Governing Law – Jurisdiction

These General Conditions are governed by Italian law, as is each Sales Contract, and are subject to Italian jurisdiction.

Any dispute relating to the General Conditions or the Sales Contracts shall be submitted to the exclusive jurisdiction of the Court of Modena, without prejudice to the applicability of mandatory provisions of law established for the protection of Consumers.

Terms of Supply

The Site indicates the estimated and overall delivery times for the Product ordered by the Customer to enter the full availability of LA VACCHETTA GRASSA, be ready for shipment, and be delivered to the Customer. Therefore, the indicated times must be considered for the delivery of the ordered Product to the Customer or the third recipient indicated by the Customer. In the event that a specific delivery term is not indicated, delivery will occur within 40 days starting from the day following the placement of the order. Availability and delivery times may vary compared to what is reported, both due to simultaneous user access and because they depend on third-party suppliers and are not controllable; but above all, given that these are handcrafted products made entirely by hand, delivery times may vary/be delayed due to the very nature of the product, or due to the need - if the item is not in stock - to procure the necessary leathers and proceed with manufacturing. LA VACCHETTA GRASSA, therefore, does not undertake or guarantee full compliance with the delivery times indicated on the Site and/or in the Order, nor will it be held responsible for any delays.

No liability, of any kind, can be attributed by the Customer to LA VACCHETTA GRASSA in case of delay in processing the Order or in delivering the Product subject to the Sales Contracts.

All shipments of Products will be at the risk of LA VACCHETTA GRASSA. The risk will transfer to the Customer upon delivery of the Products.

To correctly deliver the ordered Products, the presence of the Customer or an appointed representative is always required. Should neither of them be reachable at the time and place of delivery of the purchased Products, the courier will leave a notice of second delivery for the next working day and a telephone number to arrange a different date. The execution of the Order will remain suspended at the courier's branch, and if delivery is not possible after 5 days, the Product will return to the warehouses of LA VACCHETTA GRASSA. Once it has returned to LA VACCHETTA GRASSA, the Customer will be contacted by Customer Service and may decide whether to request a second shipment or a refund of the entire Order (excluding any cash-on-delivery fees). If the second shipment is also unsuccessful, the Order will be refunded. The relative Sales Contract will thus be automatically and definitively terminated, without prejudice to LA VACCHETTA GRASSA's right to claim for greater damages.

In cases of force majeure, unavailability of means of transport, or unforeseeable events, LA VACCHETTA GRASSA reserves the right to terminate the Sales Contract or to split, postpone, or cancel, in whole or in part, the planned delivery, should these events cause a delay in deliveries or make them difficult or impossible and/or cause a significant increase in their cost for LA VACCHETTA GRASSA. In such cases, it will be the responsibility of LA VACCHETTA GRASSA to provide timely notification of its decision to the Customer's email address. In these cases, the Customer will be entitled to obtain the refund of any price paid, excluding any further claim or compensation, of any kind, against LA VACCHETTA GRASSA.
