General Conditions for the purchase of LA VACCHETTA GRASSA products and services
LA VACCHETTA GRASSA invites each user to carefully read these general conditions of sale of products and services (the "General Conditions"), before completing any purchase and, once such transaction is completed, to print them or save a copy in digital format.
The General Conditions govern the remote purchase of products and services promoted on the website eshop.lavachettagrassamodena.it (the “Site”), owned by La Vacchetta Grassa di Cuoio di Modena srl Corso Canalchiaro 42/44 - 41121 Modena (MO) Italy.
The products distributed by LA VACCHETTA GRASSA through its Website consist, in particular, of handcrafted leather goods.
The terms and conditions for purchasing Products and/or Services offered by LA VACCHETTA GRASSA through the Site are contained in these General Conditions.
The offer of LA VACCHETTA GRASSA Products and Services is aimed at both consumer users and other users. Consumer users (“Consumer(s)”) are those who purchase the Products and/or Services presented on the Site for purposes other than any business or professional activity they may carry out in accordance with the provisions of Legislative Decree no. 206 of 6 September 2005 (the “Consumer Code”). For the purposes of these General Conditions, anyone who, when purchasing a Product or Service, expressly indicates in the form reserved for entering personal data that they belong to the category “Companies, entities, professionals holding a VAT number”, simultaneously entering their VAT number, is not considered a Consumer. Where no express reference is made to the category of Consumers, the provisions of the General Conditions and the Specific Conditions apply without distinction to all users who purchase Products and/or Services through the Site (the “Customers”).
LA VACCHETTA GRASSA may modify the General Conditions without notice. Such modifications will be effective from the date of their publication on the Website. Purchase orders placed with LA VACCHETTA GRASSA before the publication of the aforementioned modifications will be subject to the General Conditions in force at the time the sales contract is concluded.

Purchase procedure – Conclusion of the sales contract
All products and items offered by LA VACCHETTA GRASSA are UNIQUE PIECES, handcrafted. By their very nature, they always present elements of difference and uniqueness that make them absolutely unique, that is, slightly different from each other. This uniqueness and these differences—whether attributable to the leather or the workmanship—are normal in artisanal processes and actually enhance and enhance the value of the product itself.
Consequently, the visual representation of the Products on the Site, where available, generally corresponds to the photographic image of the same and has the sole purpose of presenting them for sale, without any explicit or implicit guarantee or commitment, on the part of LA VACCHETTA GRASSA, regarding the exact correspondence of the image depicted on the Site with the actual product, especially with regard to its dimensions and/or the chromatic and aesthetic aspects of the leathers.
The publication of Products and/or Services on the Site constitutes an invitation to users to submit a purchase proposal to LA VACCHETTA GRASSA. Each order submitted by the Customer constitutes a contractual proposal (the "Order") and constitutes specific acceptance of these General Conditions.
During the Order process and subsequently, the Customer may modify the information entered in the appropriate data entry forms at any time. If a specific Product and/or Service is displayed on the Site in an area other than those designated for purchasing, or if it is not possible to select the "Proceed to Purchase" icon, it will be deemed unavailable for sale. The Customer will then review the data entered in the Order and confirm and send it to LA VACCHETTA GRASSA by clicking "Proceed to Purchase." To proceed with the purchase, it will be necessary to read and accept the General Conditions, as well as the Specific Conditions, where applicable.
Once the Order has been received, LA VACCHETTA GRASSA automatically sends the Customer a confirmation email containing the Order details and all the data relating to the purchase, i.e. the type of Products and/or Services requested and the related costs.
LA VACCHETTA GRASSA reserves the right to accept or reject Orders received. In the event of non-acceptance, the Customer may not assert any rights or claims against LA VACCHETTA GRASSA under any circumstances. The sales contract will be deemed concluded (i) upon acceptance of the Order by LA VACCHETTA GRASSA, sent to the Customer's email address, or (ii) tacitly if 48 hours have passed since receipt of the Order (the "Sales Contract").
Once LA VACCHETTA GRASSA has received acceptance of the Order, the latter will arrange for the shipment of the selected Products, which will be communicated to the Customer via email.
Each Sales Contract will be archived by LA VACCHETTA GRASSA through an electronic system and may be viewed, where necessary, both by LA VACCHETTA GRASSA staff and by any third parties used by LA VACCHETTA GRASSA to execute the Sales Contract.
Price of LA VACCHETTA GRASSA Products and Services – Product Availability
The prices published on the homepages or in the various sections of the Site dedicated to each individual Product and/or Service include VAT and do not include any taxes, duties, and fees applicable in the country of destination of the Products and/or Services, if this is not Italy. These costs, which vary from country to country, are the responsibility of the Customer, who is responsible for verifying their amount with the relevant customs authorities.
The price of each individual Product and/or Service must be increased by the cost of each shipment. This cost is a flat rate and includes professional packaging, shipping insurance, and logistics management fees. The amount of this cost may vary depending on the delivery and payment method, as well as the destination country. The total amount due for the selected Products and/or Services will be clearly indicated and communicated to the Customer prior to the conclusion of the Sales Contract.
The prices listed on the Site are subject to possible changes and/or modifications by LA VACCHETTA GRASSA without any obligation to notify the Customer. These increases may depend - among other things - on increases decided by LA VACCHETTA GRASSA's suppliers. Sales Contracts concluded before the publication of the aforementioned changes, but still in progress, will be subject to the prices in effect at the time the Order is received.
Payment Methods
Payments under the Sales Contracts may be made by credit card or PayPal. When placing the Order, the Customer must indicate their preferred payment method.
If the Customer decides to proceed with the purchase of the Products and/or Services with payment of the price by credit card or PayPal, the total amount due for each Sales Contract will be charged at the same time as the conclusion of the order process.
LA VACCHETTA GRASSA reserves the right to request, at any time, that the Customer send additional information and/or documents proving ownership of the credit card used to complete the Sales Agreement. If the Customer fails to comply with these requests, LA VACCHETTA GRASSA reserves the right to refuse the Order or to withdraw from the Sales Agreement, promptly notifying the Customer at the email address indicated in the Order.
Payment via PayPal will be made by redirecting you to the PayPal website, where the transfer of the funds due to LA VACCHETTA GRASSA can be completed. The Customer's financial data will be managed directly by PayPal and will not be shared with LA VACCHETTA GRASSA. The total amount for each Sales Contract will be charged upon completion of the order process.
Communications and Complaints
All communications or any complaints regarding LA VACCHETTA GRASSA must be addressed to the LA VACCHETTA GRASSA Customer Service Department.
Intellectual property rights
The Customer declares and acknowledges that all trademarks, designs, models, distinctive signs, intellectual property, software, and databases, or any other intellectual and industrial property rights accessible from and/or reproduced on the Site in any manner and/or form, including the LA VACCHETTA GRASSA trademark, are the exclusive property of LA VACCHETTA GRASSA di Cuoio di Modena srl, or LA VACCHETTA GRASSA, nor is it a legitimate licensee (the "Intellectual Property Rights"). LA VACCHETTA GRASSA, however, is not responsible for the intellectual property rights relating to the Products and/or Services for sale, the owners of which are expressly indicated therein. Any use of the Intellectual Property Rights in any manner and/or form, in whole or in part, is prohibited without the prior written authorization of LA VACCHETTA GRASSA or its licensors.
Applicable legislation – Competent court
These General Conditions are governed by Italian law, as are each Sales Contract and subject to Italian jurisdiction.
Any dispute relating to the General Conditions or the Sales Contracts will be referred to the exclusive jurisdiction of the Court of Modena, without prejudice to the applicability of the mandatory provisions of law established for the protection of Consumers.
Terms of supply
The Site indicates indicative and overall delivery times for the Product ordered by the Customer to be fully available to LA VACCHETTA GRASSA, ready for shipment, and delivered to the Customer. Therefore, the indicated delivery times must be taken into account for delivery of the ordered Product to the Customer or to the third party recipient indicated by the Customer. If a specific delivery date is not specified, delivery will take place within 40 days from the day following the order placement. Availability and delivery times may vary from those indicated, both due to simultaneous user access and because they depend on third-party suppliers and are beyond our control. Above all, since these are artisanal products, entirely handcrafted, delivery times may be subject to variations/delays related to the nature of the product itself, or to the need—if the item is not in stock—to procure the necessary leathers and arrange for its production. LA VACCHETTA GRASSA, therefore, does not undertake or guarantee full compliance with the delivery times indicated on the Site and/or in the Order, nor will it be held responsible for any delays.
The Customer shall not be liable, under any circumstances, for any delay in processing the Order or in delivering the Product covered by the Sales Contracts.
All shipments of Products will be at the risk of LA VACCHETTA GRASSA. Risk will pass to the Customer upon delivery of the Products.
To properly deliver the ordered Products, the presence of the Customer or a designated representative is always required. If neither of them is available at the time and place of delivery of the purchased Products, the courier will leave a notice of a second delivery for the next business day and a telephone number to arrange a different date. The Order will be held at the courier's branch, and if delivery is not possible, after 5 days the Product will be returned to the LA VACCHETTA GRASSA warehouse. Once returned to LA VACCHETTA GRASSA, the Customer will be contacted by Customer Service and can decide whether to make a second shipment or request a refund for the entire Order (obviously excluding any cash on delivery). If the second shipment is also unsuccessful, the Order will be refunded. The relevant Sales Contract will then be automatically and definitively terminated, without prejudice to LA VACCHETTA GRASSA's right to seek further damages.
In cases of force majeure, unavailability of transportation, or unforeseeable events, LA VACCHETTA GRASSA reserves the right to terminate the Sales Contract or to split, postpone, or cancel, in whole or in part, the scheduled delivery, if such events cause a delay in deliveries or make them difficult or impossible and/or cause a significant increase in their costs to LA VACCHETTA GRASSA. In such cases, LA VACCHETTA GRASSA will promptly communicate its decisions to the Customer's email address. In such cases, the Customer will be entitled to a refund of any price paid, excluding any further claims or compensation, of any kind, against LA VACCHETTA GRASSA.
Withdrawal conditions
Customer's Right of Withdrawal – LA VACCHETTA GRASSA Withdrawal
Pursuant to Articles 64 et seq. of the Consumer Code, the Consumer has the right to withdraw from the purchase without penalty and without specifying the reason. To this end, he or she must notify LA VACCHETTA GRASSA Customer Service by email (to info@lavachettagrassamodena.it ) or, alternatively, by fax or registered letter with acknowledgement of receipt, to be sent within 14 working days of receiving the selected Products and/or Services.
The return of the Products subject to withdrawal must be made, at the Consumer's expense, by a courier of their choice, to the following address: La Vacchetta Grassa di Cuoio di Modena srl Corso Canalchiaro 42/44 - 41121 Modena (MO) Italy.
In order to validly exercise the right of withdrawal, the Consumer must comply with the following conditions and procedures:
the right of withdrawal may also be applied only to individual Products which are the subject of a single Sales Contract, without prejudice to the fact that the Consumer may not exercise the right of withdrawal only in relation to a part of the individual Product purchased;
All Products for which the Consumer has exercised the right of withdrawal must be returned intact and appropriately packaged, preferably in their original packaging, complete with any accessories.
if the Product for which the right of withdrawal has been exercised arrives damaged to LA VACCHETTA GRASSA, the latter will be required exclusively to notify the Consumer in order to allow him, where possible, to exercise his right of recourse against the courier chosen for the return of the products;
LA VACCHETTA GRASSA will not be liable under any circumstances for damage, theft, or loss of returned Products until they have been returned. All risks will therefore be borne exclusively by the Consumer.
Once the integrity of the returned Product has been verified, LA VACCHETTA GRASSA will refund the Consumer the full amount paid for the Products and/or Services under the Sales Contract subject to withdrawal, no later than 14 days after receiving the same from the Customer's notice of withdrawal. LA VACCHETTA GRASSA reserves the right to withhold the refund until the returned products are received. The refund will be made using the credit card details provided by the Consumer when placing the Order.
If the Consumer violates, in whole or in part, the provisions set forth in these General Conditions regarding withdrawal, the Sales Contract will remain valid and effective and LA VACCHETTA GRASSA will return the Products unduly returned to the Consumer, charging the latter the relevant shipping costs.
LA VACCHETTA GRASSA has the right to withdraw from each Sales Contract concluded by the Customer or Consumer, by giving written notice to the same via email and registered mail with return receipt, and may not accept any Order from users or Customers who have engaged in irregular behavior, have not accepted the Products purchased cash on delivery, are suspected of conduct contrary to the law or are required to do so by an order of a judicial authority.
Warranty - Returns
If the Products or Services are covered by a conventional warranty recognized by the manufacturer, any defects, faults, or non-conformities must be reported directly to the manufacturer as indicated on the Product packaging or in the information brochure. Except as otherwise provided by law, LA VACCHETTA GRASSA declares that it has no liability for product faults, defects, or non-conformities. The Consumer guarantee pursuant to Legislative Decree 206/2005 remains unaffected.
In this case, the Consumer must, under penalty of forfeiture, report the defect found to LA VACCHETTA GRASSA Customer Service (at the address: info@lavachettagrassamodena.it ) within 2 (two) months of the date of discovery.
LA VACCHETTA GRASSA will make every reasonable effort to replace the defective product, at its own expense and within a reasonable timeframe. If this is not possible, or is excessively costly for LA VACCHETTA GRASSA, the Consumer will have the right to terminate the Sales Contract and, consequently, to obtain a refund of the sums paid for the purchase and shipment of the Product, excluding any further liability of LA VACCHETTA GRASSA, for any reason whatsoever.
If the Customer notices any discrepancies between the order and the product received, and in particular, any problems with the physical integrity, correspondence, or completeness of the products received, he or she must promptly inform LA VACCHETTA GRASSA Customer Service. Customer Service will provide the necessary information to resolve the issue and, where possible, ship the missing items, replace defective items, or issue a refund. Under no circumstances will the Customer be required to return defective or mistakenly received items at their own expense.
